1. Acceptance of Terms
By booking, purchasing, or using any service provided by RDT121 Driving School (“RDT121”, “we”, “us”, “our”), you (“the Student”, “Participant”, or “Applicant”) agree to be bound by these Terms of Service.
RDT121 Driving School reserves the right to update or amend these Terms at any time without prior notice. Continued use of our services constitutes acceptance of the revised Terms.
2. Lesson Attendance & Non-Attendance
Any lesson cancelled or requested to be rescheduled within 24 hours of the scheduled start time will incur a full cancellation fee, equal to the cost of the booked lesson(s).
Failure to attend a scheduled lesson without notice will be treated as a cancellation and charged in full.
3. Cancellations & Rescheduling
3.1 Standard Driving Lessons
Lessons cancelled with less than one (1) business day’s notice will be charged at the full lesson fee.
Due to short notice, reserved time slots cannot be refilled. Our services are time-based.
3.2 Driving Test Packages & Car Hire
A Driving Test Package or Car Hire for Driving Test is fully payable if cancelled with less than two (2) business days’ notice.
Driving test bookings are given highest priority and are often reserved weeks or months in advance. Late cancellations result in a total loss of the reserved booking.
3.3 Test Termination – Applicant Responsibility
If a driving test is terminated by the testing officer due to any fault or omission by the applicant (including incorrect or incomplete logbook, missing documents, or ineligibility), the full Driving Test Package fee remains payable.
3.4 Test Rescheduled by Service NSW
If Service NSW reschedules a driving test on the same day, a 2.5-hour lesson fee is payable for the reserved service time.
3.5 Test Termination – Vehicle Fault
If a test is terminated due to a fault with the RDT121 instructor vehicle:
No lesson fee will be charged, and
The Service NSW test rebooking fee will be fully compensated to the applicant.
4. Lesson Packages & Validity
Standard lesson packages are valid for three (3) months from the date of purchase or first lesson, whichever occurs first.
Packages that include multiple driving test car hire options are valid for six (6) months.
Once the driving test is successfully passed, any remaining services in the package are terminated, non-refundable, and non-transferable.
Packages cannot be cancelled due to change of mind.
Remaining services may be transferred once to another participant recommended by the purchaser, subject to approval.
In rare cases where RDT121 must reschedule a lesson due to unforeseen instructor unavailability, the lesson will be rescheduled at no additional cost, provided it was prepaid or part of a package.
5. Use of Instructor Vehicle for Driving Test
When hiring an RDT121 instructor vehicle for a driving test, the learner accepts full responsibility for:
5.1 Vehicle Damage
If the learner is at fault, or fault cannot be identified, the learner agrees to pay a maximum insurance excess of $750, or the repair cost if it is less than $750.
5.2 Theft or Loss
The learner is fully responsible for any theft or total loss of the vehicle during the booking period.
6. Fines, Penalties & Legal Costs
Any traffic fines or penalties issued during lessons or driving tests (including speeding, red-light offences, mobile phone use, or driving without a valid licence) are fully payable by the student, regardless of when the fine is issued.
Mobile phone use is strictly prohibited while seated in the driver’s seat when the vehicle is on and not parked.
If RDT121 Driving School or its instructor is required to take action to recover unpaid amounts, RDT121 reserves the right to charge loss-of-time costs, calculated at the applicable hourly lesson rate.
